A marital settlement agreement is an agreement reached by both parties to a divorce action that resolves all of the issues presented by both parties in a divorce. If it is possible to reach an agreement as to the issues between the parties in an Alabama divorce, I always encourage my clients to consider a settlement agreement as reaching an agreement is more time and cost efficient.
A marital settlement agreement in an Alabama divorce will address all of the issues between the parties, including custody, visitation, and support, as well as division of the parties’ marital assets, such as the marital home, the parties’ financial and retirement accounts, the parties’ debts, the parties’ personal property, and the like. It is important for parties to remember that they know more about their entire life together, their children, and their stuff than any stranger in a black robe can ascertain in the short amount of time that the judge has to consider their case, no matter how competent and esteemed as our judges are.
A settlement agreement allows the parties to control the terms of their divorce and, while it will include compromises, it will also yield a result that they had input in and bargained for.
