Lawyers and judges are comfortable in divorce court, but for most people, it is one of the scariest parts of an impending divorce, simply because it can be difficult to know exactly what to expect. But by preparing yourself, nothing will be unexpected. When preparing for divorce court, here are some dos and don’ts to keep in mind before the divorce process.

  1. Don’t expect your lawyer to do all the work for you. If you show up to fill a chair and do nothing else, a surprise in the courtroom may derail your case, and you will not be able to follow the changes. Pay attention so you can stay on track to get what is most important to you in your settlement.
  2. Do familiarize yourself with all documents involved in the proceedings, including financial ones. Even if you think the proceedings will go one way, the result is not a sure thing. The more prepared you are with potential changes, the calmer you will be.
  3. Do not let emotion beat logic. Even though this is an emotional time, generally, court is a place for logical appeals, not emotional ones, and anger clouding your judgment can cause you to lose track of what you are trying to accomplish with this divorce.
  4. Do stick with the truth. It can be tempting to twist facts or omit details to paint a more flattering picture, especially if that’s what your spouse is doing, but if you do so, you risk the truth coming out and affecting your case negatively.
