Grounds for Divorce in Alabama

In the State of Alabama, you might be surprised to know that there exists a multitude of differing grounds a party can file for divorce based upon. These various grounds are purely statutory and separated into the categories we refer to as “Fault Grounds” and “No Fault Grounds” The no-fault grounds for divorce include: (1) incompatibility of temperament and (2) irretrievable breakdown of the marriage. As the name suggests, “No-Fault” Grounds provide the parties’ a divorce while establishing that neither party’s specific conduct resulted in the dissolution and breakdown of the marriage, but simply that the parties’ have grown apart, such that their marriage is not practicable to continue. On the other hand, “Fault” Grounds focus more on the conduct of one particular party to the marriage and includes but is not limited to things such as: (1) Abandonment, (2) imprisonment, and (3) adultery. Alleging one of the “Fault” Grounds will require the complaining party to introduce evidence supporting the allegations of fault.
