Do Both Parties Have To Agree To Divorce In Alabama?

You Don’t Need Mutual Agreement To Move Forward 

Under Alabama law, once one spouse files for divorce, the court can move forward with or  without the other spouse’s agreement. After filing the initial complaint, the non-filing spouse has  30 days to respond. If they don’t, the court may issue a default judgment—meaning the filing  spouse could be granted everything they requested. While it’s always ideal to reach mutual  understanding, your divorce is not held hostage by the other party’s refusal to cooperate.
