The biggest legal hurdle in a stepparent adoption is the rights of the other biological parent. Adoption requires that those rights be legally terminated, either through consent or by court order.
In some cases, the other parent may have been out of the child’s life for years. If they don’t respond to legal notices or fail to appear in court, the court can grant the adoption after all legal protocols are followed. It’s a more involved process, but entirely doable with the right legal support.
Sometimes, a previously absent parent may suddenly reappear—by filing an objection or attending the hearing. If this happens, the court will appoint an attorney to represent the child’s best interests, known as a Guardian Ad Litem, and the case may proceed to a contested hearing.
